Terms of Use

These Terms of Use ("Terms") govern your access to and use of the VariantDoku iOS application ("the App") and the website located at variantdoku.com ("the Website"), together "the Service", operated by VariantDoku ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.

2. License

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App for your own non-commercial use on devices you own or control.

This license does not include any right to: (a) modify, reverse engineer, decompile, or disassemble the App, except as permitted by applicable law; (b) sublicense, sell, lease, or rent the App; (c) remove proprietary notices; or (d) use the App in a manner that could damage, disable, overburden, or impair the Service.

3. Subscriptions and In-App Purchases

3.1 Variant+ subscriptions

Variant+ Monthly and Variant+ Yearly are auto-renewing subscriptions. By purchasing, you acknowledge:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the renewal price.
• You can manage and cancel subscriptions in your Apple ID account settings (Settings → [your name] → Subscriptions).
• Any unused portion of a free trial period will be forfeited when you purchase a subscription, where applicable.

3.2 Free trials

If a free trial is offered, you must cancel at least 24 hours before the trial ends to avoid being charged for the subsequent subscription period. Trials are limited to one per Apple ID per subscription group.

3.3 Lifetime purchase

The VariantDoku Lifetime purchase is a one-time, non-refundable, non-consumable in-app purchase. It grants ongoing access to the features described as "included" at the time of purchase, on devices signed in with the same Apple ID. Future features that have ongoing operational costs (for example, AI-assisted features) may be sold as separate products and are not included unless explicitly stated.

3.4 Refunds

All purchases are processed by Apple and are subject to Apple's refund policies. Refund requests must be submitted directly to Apple at reportaproblem.apple.com.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to our backend, other users' data, or related systems.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Use any automated means to access or interact with the Service except as expressly permitted.

5. Intellectual property

The App, the Website, all puzzles distributed through the Service, the VariantDoku name and logo, and all related software, designs, and content are owned by us or our licensors and are protected by copyright, trademark, and other applicable laws. No rights are granted to you except as expressly set out in these Terms.

6. User content

The Service does not currently allow you to upload, post, or share user-generated content. If this changes, we will update these Terms accordingly.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive termination.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $10, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

11. Indemnification

You agree to defend, indemnify, and hold harmless VariantDoku and its operators from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Service.

12. Apple-specific terms

You acknowledge that these Terms are between you and us only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. To the extent these Terms provide for usage rules less restrictive than the App Store Terms of Service, the App Store Terms of Service apply. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Poland, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Service shall be resolved in the competent courts of Poland, unless mandatory consumer protection laws of your country of residence provide otherwise.

14. Changes to these Terms

We may modify these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after a change indicates acceptance of the updated Terms. If a change is material, we will make a reasonable effort to notify you in-app or via the Website.
